Chain of Title & Abstract of Title

The chronological historical sequence of all recorded ownership transfers, deeds, mortgages, and liens affecting a parcel of real property from its original grant to the present owner.

Overview & Practical Application

The Chain of Title is the unbroken historical record of all conveyances, deeds, inheritance probate decrees, easements, and encumbrances recorded in the county land records for a specific parcel of real estate.

Before any mortgage lender funds a home loan or a title insurer issues a policy, a professional title abstractor conducts a Title Search to compile an Abstract of Title (typically examining 40 to 60+ years of county grantor-grantee indexes).

If there is a missing link in the chronological sequence — such as an unrecorded deed, an improperly released prior mortgage lien, a forged signature, or an omitted heir from an estate — it creates a "Cloud on Title" (Defective Title). A cloud on title prevents the seller from conveying Marketable and Insurable Title until it is resolved via a Corrective Deed, Release of Lien, or a judicial Suit to Quiet Title.

Real-World Underwriting Example

Scenario: During a title search for a home sale, the examiner discovers a $25,000 contractor mechanic’s lien from 2019 and a paid-off 2016 HELOC whose bank never recorded a formal Satisfaction of Mortgage.

Calculation:
Title Commitment Schedule B-I Requirements: (1) Pay off or bond around the $25,000 mechanic’s lien at closing; (2) Obtain and record a formal Lien Release from the 2016 HELOC bank.

Takeaway: Both clouds on title are cleared prior to funding, restoring an unbroken Chain of Title for the new buyer and lender.

Key Underwriting Takeaways

  • An unbroken Chain of Title is a mandatory prerequisite for obtaining mortgage financing and Title Insurance.
  • Clouds on title are cured either administratively (recording a satisfaction of lien or quitclaim deed) or judicially via a Quiet Title Action.
  • Owner’s Title Insurance financially protects the buyer if a hidden defect in the historical Chain of Title surfaces after closing.
